Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website at wazikenya.org (the “Site”), operated by Wazi Community Based Organization (“Wazi”, “we”, “us”, “our”), a registered Community-Based Organization (Registration No. HUD.GPO/KAS/CBO/08/2023/015) based in Ruaraka, Nairobi, Kenya. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About this website

The Site exists to share information about Wazi’s mission, programs, and impact, and to let you contact us, apply to volunteer, explore partnerships, and support our work. The Site is provided for general information and engagement. It is not a substitute for professional, medical, legal, or financial advice.

2. Acceptance and changes to these Terms

By using the Site you confirm that you can form a binding agreement with us and that you will comply with these Terms and all applicable laws. We may update these Terms from time to time. When we do, we will post the revised version on this page and update the effective date. Your continued use of the Site after changes take effect means you accept the revised Terms.

3. Intellectual property

Unless stated otherwise, all content on the Site, including text, photographs, graphics, logos, video, and design, is owned by Wazi or its contributors and partners and is protected by copyright and other laws. The Wazi name, logo, and the tagline “Open Spaces. Youth-Led Action.” are our marks. You may view and share links to our content for personal, non-commercial purposes. You may not copy, reproduce, republish, distribute, or use our content or marks for any other purpose without our prior written permission. Photographs of identifiable people are used with care and may not be reused.

4. Acceptable use

You agree not to:

  • use the Site for any unlawful, harmful, or fraudulent purpose;
  • attempt to gain unauthorised access to the Site, its server, or any connected systems;
  • introduce malware, attempt to disrupt the Site, or place excessive load on it through automated scraping or similar means;
  • misrepresent your identity or your affiliation with any person or organization;
  • collect or harvest personal data of other users, or use the Site to send unsolicited communications.

5. Donations

Donations made through the Site, including via M-Pesa (Paybill 247247, Account 0714822852) and linked platforms such as M-Changa, support Wazi’s programs and operations. Please make sure the details you enter are correct before confirming a payment. Donations are generally non-refundable. If you believe you have made a payment in error, contact us promptly at info@wazikenya.org and we will try to assist. Tax treatment of donations depends on the laws of your country; we do not provide tax advice.

6. Volunteer and partnership enquiries

Submitting a volunteer application or partnership enquiry does not create any obligation on Wazi to accept it, and does not by itself form a volunteering or partnership agreement. Any placement or partnership is subject to a separate process and, where relevant, a separate agreement. Volunteer intake runs on an annual cycle as described on the Site.

7. Third-party links and content

The Site may link to or embed third-party websites and content (for example funders, partners, donation platforms, and social media). We provide these for convenience and do not control or endorse them, and we are not responsible for their content, products, or practices. Your use of third-party services is governed by their own terms and policies.

8. Accuracy of information

We work to keep the information on the Site accurate and current, including our impact figures, but we provide it in good faith and without guarantee. Information may change, and we may update or correct content at any time without notice.

9. Disclaimer of warranties

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties of any kind, express or implied, about the Site’s operation, availability, accuracy, or fitness for a particular purpose, and we do not warrant that the Site will be uninterrupted, secure, or error-free.

10. Limitation of liability

To the fullest extent permitted by applicable law, Wazi and its team, volunteers, and partners will not be liable for any indirect, incidental, or consequential loss or damage arising from your use of, or inability to use, the Site or any content on it. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

Our use of personal data is described in our Privacy Policy, which forms part of these Terms. Please read it to understand how we collect and use your information.

12. Governing law and disputes

These Terms are governed by the laws of Kenya. Any dispute arising out of or relating to the Site or these Terms is subject to the jurisdiction of the courts of Kenya. We encourage you to contact us first so we can try to resolve any concern informally.
